2. Eligibility

Service Limitations

We strive for excellent results, but AI technology has limitations:

• Results depend on the quality of photos you upload
• Not all generated images may meet your expectations
• Processing times may vary based on server load
• Service availability is not guaranteed 24/7

5. Photo Upload & Usage Rights

Your Photo Rights

When you upload photos to HeadshotAI, you represent and warrant that:

• You own the photos or have permission to use them
• The photos are of you (or someone who has given explicit consent)
• The photos don't violate any third-party rights
• The photos don't contain illegal or prohibited content

What We Do With Your Photos

When you upload photos, we:

• Train a custom AI model specifically for you
• Generate headshots based on your selected styles
• Store photos temporarily (deleted after 30 days)
• Do NOT use your photos to train general AI models
• Do NOT share or sell your photos to third parties

Ownership of Generated Headshots

You retain full ownership and commercial rights to all headshots generated by HeadshotAI. You may use them for:

• Personal and professional profiles (LinkedIn, resume, etc.)
• Business cards and marketing materials
• Website and social media
• Any lawful commercial or personal purpose

6. Prohibited Uses

You may NOT use HeadshotAI to:

• Create deepfakes or misleading content: No impersonation or fraudulent representations
• Upload photos without consent: No unauthorized use of others' photos
• Generate illegal content: No nudity, violence, hate speech, or illegal activities
• Harass or harm others: No stalking, doxxing, or malicious use
• Violate intellectual property: No copyrighted or trademarked content
• Automate or scrape: No bots, scripts, or automated access
• Resell or redistribute: No white-labeling or unauthorized commercial use of our service
• Reverse engineer: No attempts to copy or replicate our technology

Violation of these prohibitions may result in immediate account termination and legal action.

7. Pricing & Payment

Service Plans

HeadshotAI offers multiple pricing tiers with different features. Current pricing is available on our website and may change with notice.

Payment Terms

• All payments are processed securely through Stripe
• Prices are in USD unless otherwise stated
• Payment is required before service delivery
• We do not store your credit card information

Refund Policy

Money-Back Guarantee: If you're not satisfied with your results, we offer refunds under these conditions:

• Request within 7 days of receiving your headshots
• You followed our photo upload guidelines
• Technical issues prevented proper generation
• Quality issues that are our fault

No refunds if:

• Low-quality input photos were uploaded
• You violated photo upload guidelines
• More than 7 days have passed
• Headshots have already been used/downloaded extensively

8. Intellectual Property

Our IP Rights

HeadshotAI, including our technology, algorithms, website design, logo, and branding, are owned by us and protected by intellectual property laws. You may not:

• Copy or reproduce our technology
• Use our branding without permission
• Create derivative works based on our service
• Reverse engineer our AI models

Your IP Rights

You retain all rights to your uploaded photos and generated headshots. We claim no ownership over your content.

AI Limitations

You acknowledge that AI-generated content:

• Can have minor artifacts or imperfections

• Is continuously improving but not perfect

12. Indemnification

You agree to indemnify and hold harmless HeadshotAI, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your violation of these Terms
• Your use of the service
• Your uploaded content
• Infringement of third-party rights
• Your violation of any laws or regulations

13. Dispute Resolution

These Terms are governed by the laws of Norway, without regard to conflict of law provisions.
